Supreme Court: Permanent injunction in favour of Telangana State Wakf Board reinstated

The Supreme Court allowed the Wakf Board’s appeal, restoring the permanent injunction over the 16‑acre Mafi Inam land and dismissing the contempt petitions.

The Supreme Court, by a two‑judge bench, allowed the appeal filed by the Telangana State Wakf Board and restored the permanent injunction that restrains the defendants from interfering with the possession of the 16‑acre Mafi Inam land adjoining Qutub Shahi Mosque. The Court held that the Board’s title and possession were lawful and unclouded, thereby justifying the injunction.

The Board asserted that the 16‑acre parcel, classified as ‘Mafi Inam’, had been notified as wakf property under the 1989 gazette under the Wakf Act. The Board relied on the Survey Commissioner’s report confirming the land’s status and argued that no valid title existed in favour of the defendants. The defendants, on the other hand, claimed possession based on a sale deed and a pattadar, contending that they had acquired the land lawfully. The trial court had granted a permanent injunction in favour of the Board, which the High Court later set aside.

The principal issue was whether the Board possessed a clear title and lawful possession sufficient to sustain a permanent injunction, and whether the High Court was correct in overturning the trial‑court decree. The Supreme Court examined the 1989 gazette notification, the Survey Commissioner’s report and the absence of any timely challenge within the statutory limitation period. Relying on established principles that an injunction is appropriate where title is undisputed and possession is proven, the Court set aside the High Court order, reinstated the injunction and dismissed the contempt petitions.
