Supreme Court: Parallel trademark suits transferred to Ahmedabad

The Supreme Court ordered both parallel trademark infringement suits to be transferred to the City Civil Court, Ahmedabad, consolidating the proceedings in a single forum.

The Supreme Court, comprising Justices S.V.N. Bhatti and N.V. Anjaria, decided to transfer two parallel commercial suits concerning trademark infringement to the City Civil Court, Ahmedabad. It directed the Indore District Commercial Court and the Delhi High Court to move the cases accordingly, and set a hearing date for the parties.

The factual backdrop involved M/s Supreme Industries Ltd. being the defendant in a suit filed by M/s Supremo India Private Ltd. in the Indore District Commercial Court (CS‑Comm No. 134/2025) and the plaintiff in a suit filed by the same respondent in the Delhi High Court (CS‑Comm No. 1294/2025). Both parties filed transfer petitions seeking to shift the opposite suit to their preferred jurisdiction, raising the question of whether the suits should be consolidated in a single forum.

The Court exercised its jurisdiction to prevent multiplicity of litigation and noted that the parties had concurred on a common venue. It refrained from commenting on the substantive trademark issues and ordered that both suits be transferred to the City Civil Court, Ahmedabad, with a hearing fixed for 26 November 2026 in the next month.
