Supreme Court: Expunged High Court Remarks Against IPS Officer
The Supreme Court ordered removal of adverse observations against an IPS officer in a High Court judgment while leaving the substantive decision unchanged.
The Supreme Court, hearing A. Arun v. Varsha Sharma (2026 INSC 1186) on 2 November 2026, directed that specific adverse observations made by the High Court against an IPS officer be expunged, without altering the High Court’s substantive order setting aside the officer’s preventive detention order.
The appellant, an IPS officer, had ordered the preventive detention of an individual under the Tamil Nadu Prevention of Dangerous Activities Act, 1982. The High Court later set aside that detention and, in its judgment, criticised the officer’s conduct in several paragraphs. The officer appealed, seeking removal of the critical remarks while the substantive order remained intact.
The Supreme Court noted the importance of strict compliance with procedural safeguards in preventive detention cases but accepted the officer’s unconditional apology and his assurance of greater care in the future. Finding these factors sufficient, the Court ordered the expungement of paragraphs 6, 8, 10 and 19‑23 of the High Court judgment, leaving the High Court’s substantive order untouched and disposing of the appeal accordingly.
