Supreme Court: Conviction upheld for Sub Registrar’s disproportionate assets

The Supreme Court dismissed the appeal, affirmed the conviction under Sec.13(1)(e) of the PC Act and ordered the appellant to surrender to serve the remaining term.

The Supreme Court, comprising Justices Sanjay Kumar and Sanjeev Sachdeva, dismissed the appeal filed by V. Gopalakrishnan, a Sub Registrar, against his conviction for criminal misconduct under Sections 13(1)(e) and 13(2) of the Prevention of Corruption Act, 1988. The Court upheld the High Court’s reduction of sentence, vacated the interim bail, and directed the appellant to surrender within two weeks to serve the balance of his term.

The factual matrix revealed that the appellant possessed assets valued at Rs.12.37 lakh for the period 1993‑2001, while his disclosed income amounted to Rs.10.12 lakh, resulting in a disproportionate excess of Rs.5.25 lakh, approximately 52 % of his income. The prosecution’s asset valuations were accepted by the trial court. The appellant’s attempts to assign lower values to the assets were rejected because they were not supported by any documentary evidence, leaving a substantial unexplained surplus.

The Court examined whether the appellant’s failure to satisfactorily account for the excess assets satisfied the burden of proof under Section 13(1)(e). It noted that even after adjusting the appellant’s alleged over‑valuations, the surplus remained above the statutory 10 % threshold and exceeded 26 % of his income. Consequently, the prosecution’s prima facie case was deemed established, the appellant’s explanations were deemed untenable, and the conviction was affirmed.
